Expert Advice

If you have a problem with an installation or you are in dispute with an installer or  supplier you may need to employ an Expert Witness to provide a report or to give advice.

We have a list of members who are able to provide expert advice and prepare expert reports.

A full expert report is not always necessary, and with disputes involving relatively small sums it may not be cost effective to employ an Expert, however this sort of decision can only be made if you have discussed the matter with your Legal Advisor or with an Expert.

You may not find an Expert in your particular area, however all of those Experts on our list are willing to provide initial advice over the phone or by E-mail with no charge.

The list below comprises members of the CIPHE registered with the Engineering Council who undertake expert witness work and provide expert advice.

Before appointing anyone to provide expert advice, enquiries should be made with the person in question to confirm that they have the relevant expertise, are suitably qualified for the matter in hand and hold all relevant insurances including professional Indemnity and public liability.

Certain aspects of an appointment may require separate registration, for example a gas installation or fittings, and the Expert should be asked to provide the relevant details before being appointed.

Current Court policy encourages the engagement of a Single Expert to act on behalf of both parties in a dispute (A Single Joint Expert).

Enquires should be made to confirm that the Expert is able and willing to act as a Single Joint Expert. If there is any doubt as to what services are required you should discuss this with your Legal Advisors.

All Experts, whether appointed as a Party Expert or a Single Joint Expert are obliged to comply with the Civil procedure Rules and undertake that their first duty is to the Court.

The terms of engaging an Expert including the payment of fees etc is strictly a matter between you and the Expert and it is recommended that a formal agreement is made when appointing an Expert.
